Is CBD legal in all 50 states?

Hemp-derived CBD with less than 0.3% delta-9 THC is federally legal under the 2018 Farm Bill. Every state allows some form of CBD retail. However, three states — Idaho, Kansas, and (until recently) Mississippi — have stricter rules that effectively prohibit any detectable THC, even trace amounts under the federal threshold. Choose broad-spectrum (THC-free) CBD if you live in those states.

Can I travel between states with CBD?

If you carry hemp-derived CBD that complies with the federal Farm Bill (under 0.3% THC), it is legal under federal law and the TSA permits it in carry-on bags. State-line transit is generally not enforced, but you should not carry CBD products across state lines into a stricter-rules state (Idaho, Kansas) if you intend to use them there.

Why do some states ban hemp-derived delta-8 THC if hemp is federal-legal?

The 2018 Farm Bill federalized hemp containing under 0.3% delta-9 THC, but did not address other hemp-derived intoxicating cannabinoids like delta-8, delta-10, HHC, and THC-O. States have taken divergent approaches — some ban these compounds outright, others limit them to licensed cannabis retailers, others permit them at general retail. Standard CBD oils (cannabidiol, not delta-8) are unaffected by these state-by-state delta-8 restrictions.

What is the minimum age to buy CBD?

Most states have set 21 as the minimum age to purchase CBD products at retail, mirroring the alcohol/cannabis framework. A handful of states (Arizona, Idaho, New Hampshire) permit purchase at 18. Online retailers, including botanCBD, age-gate at the higher of 21 or the state minimum.

Can I be fired for using CBD?

Yes, in most states. Even broad-spectrum CBD with no detectable THC carries a small risk of false-positive drug screens; full-spectrum CBD with trace THC can produce a positive result over weeks of consistent use. A small but growing number of states (California, New York, New Jersey, Washington, Connecticut, others) restrict employers from disciplining off-duty cannabis use, but exceptions exist for federal-contractor and safety-sensitive roles. If you are drug-tested, choose broad-spectrum CBD.
