Detailed background
Idaho has the strictest CBD law in the United States. Under Idaho Code §37-2701, CBD products must contain ZERO THC — not 'less than 0.3%' — to be legal in the state. Full-spectrum CBD products that comply with the federal Farm Bill (less than 0.3% THC) are NOT legal in Idaho.
For Idaho residents: choose broad-spectrum (THC-removed) or CBD-isolate products only. Verify the COA shows non-detectable THC. Full-spectrum products carry trace THC and do not meet that standard.
This is the state's own reading, not ours. The Idaho Office of Drug Policy says CBD oil is legal in Idaho if it is processed from industrial hemp, not marijuana, and has no THC at all, and that hemp-derived CBD with 0.3% THC is classified as marijuana in Idaho. Licensed hemp handlers in Idaho may receive raw hemp with up to 0.3% THC, but the finished product has to reach zero, and ODP states that any product found in retail in Idaho must contain zero percent THC. Under the Idaho Code definition ODP quotes, a product that contains any tetrahydrocannabinol creates a presumption that it is marijuana.
Why Idaho differs from its neighbors: the 2018 Farm Bill made hemp with under 0.3% THC federally legal, and most states adopted that line. Idaho did not. It legalized growing and processing industrial hemp in 2021 (HB 126), and a 2019 executive order lets Farm Bill hemp travel through the state, but neither changed the zero-THC rule for the products people buy.
