Detailed background
Pennsylvania's Hemp Farming Act (Act 92, 2016) authorized hemp cultivation. The state aligns with the federal Farm Bill on hemp-derived CBD retail. Pennsylvania has been comparatively permissive with hemp-derived consumable products.
Today the state's hemp program runs under the Controlled Plants and Noxious Weeds Act (Act 46 of 2017). The Pennsylvania Department of Agriculture issues permits to grow and process hemp under the PA Hemp General Permit; for 2026 it lists 170 growing permits and 32 processing permits. Those permits cover farms and processors. Buying, owning and using a finished CBD oil does not need a permit, a card or a prescription.
Where Pennsylvania draws its line is food. The Department of Revenue's CBD page states that, under current federal and state law, it is unlawful to sell for human consumption any food, nutritional or dietary supplement, candy, chewing gum or beverage containing CBD as an additive. That is why you will see CBD oils, drops and topicals on Pennsylvania shelves but should be wary of CBD gummies or CBD drinks sold in the state.
There is no Pennsylvania age floor for hemp products yet. In September 2026 State Sen. Dawn Keefer circulated a memo for a Pennsylvania Hemp and Cannabinoid Act that would add Department of Agriculture registration, independent testing, truthful labels and 21-and-over sales with ID checks; she wrote that today there is no Pennsylvania age gate. The bill had not been filed when we last reviewed this page. Recreational marijuana is still not legal in Pennsylvania; marijuana-derived CBD is available only through the state's medical marijuana program (Act 16 of 2016).
