Detailed background
Ohio Senate Bill 57 (2019) decoupled hemp and CBD from the state's controlled substances act and authorized retail sale of hemp-derived CBD with under 0.3% THC. Ohio's hemp program operates through the Ohio Department of Agriculture, and adult-use marijuana was legalized via Issue 2 (November 2023, effective late 2024).
Senate Bill 56 changed the picture. Governor DeWine signed it December 19, 2025 and it took effect March 20, 2026. It reclassifies any hemp product containing more than 0.4 mg of total THC per container as marijuana, which means those products may only be sold through licensed dispensaries — not gas stations, not smoke shops, not CBD shops, not online retailers. Delta-8, THCA flower, and hemp THC beverages came off general-retail shelves statewide. Ohio adopted the 0.4 mg per-container standard roughly eight months before the same number takes effect federally.
What still works at ordinary retail: non-intoxicating CBD that stays under the cap. Broad-spectrum (THC-removed) oils, capsules, and topicals are fine.
