Tennessee's hemp rules moved twice in two years. HB 1520 (2024) set a 21+ age floor and packaging requirements. Then Public Chapter 526, signed by Governor Bill Lee on May 21, 2025, reclassified THCA above 0.3% on a dry weight basis as marijuana and moved regulatory authority from the Department of Agriculture to the Tennessee Alcoholic Beverage Commission. The TABC finalized its rules in spring 2026; the statutes took effect January 1, 2026 and the THCA ban and TABC licensing transition landed July 1, 2026.
THCA had been driving roughly three-quarters of hemp sales in Tennessee, so this reshaped the market.
