Detailed background
Texas HB 1325 (2019) authorized hemp cultivation and retail aligned with the federal Farm Bill, with the Department of State Health Services registering, testing, and labeling consumable hemp products. Ordinary CBD oils, capsules, and topicals under 0.3% delta-9 THC have been legal throughout and are not what the last two years of fighting has been about.
SB 3 would have banned nearly every hemp cannabinoid except CBD and CBG. It passed both chambers in 2025 and Governor Abbott vetoed it on June 22, 2025, citing likely unconstitutionality and the federal court injunction that blocked a similar Arkansas ban. In September 2025 Abbott issued Executive Order GA-56 instead, directing DSHS and the Alcoholic Beverage Commission to use existing authority: hemp THC products are 21+ only, government-issued ID is required at every in-person sale, and TABC licensees who sell to minors lose their permits. GA-56 remains in effect for retail; botanCBD does not collect a date of birth, scan ID, or upload a document at checkout.
DSHS adopted long-term labeling, testing, inspection, and fee rules on March 31, 2026. The Texas Hemp Business Council sued; a temporary injunction ran into mid-2026, was lifted on appeal, and as of this review the challenged rules are in effect and enforceable while the litigation continues. Smokable hemp is in the same unsettled place — the state lost a 2022 case over its smokable hemp ban, and an April 2026 ruling put smokable products back on shelves for now.
