Detailed background
Florida's hemp program is administered by the Florida Department of Agriculture and Consumer Services (FDACS) under Florida Statutes §581.217. The state requires hemp-derived consumable products to carry batch numbers, COA links via QR code, and FDACS registration. SB 1676 (2023) imposed stricter labeling and youth-marketing rules and set the purchase age at 21.
Florida has now turned back hemp restrictions three sessions running. Governor DeSantis vetoed SB 1698 in June 2024, which would have capped delta-8 and other intoxicating cannabinoids. SB 438 passed the Senate in 2025 but died in the House. The 2026 session adjourned March 13, 2026 with no hemp bill enacted. Standard hemp-derived CBD oils, capsules, and topicals under 0.3% delta-9 THC are legal and widely sold.
The one rule that did change came from the agency, not the legislature: FDACS Rule 5K-4.034, effective June 16, 2025, measures compliance using total delta-9 THC (delta-9 plus 0.877 times THCA) rather than delta-9 alone. That is aimed at high-THCA hemp flower and does not affect ordinary CBD oil.
