CBD vs Delta-8 THC: The Honest Comparison

Delta-8 is made from CBD

Hemp does produce delta-8 THC naturally, but only in trace amounts — far too little to extract and sell. So the delta-8 in nearly every product on the market starts as CBD, which is then converted into delta-8 in a lab using acid catalysts, a process called isomerization.

That's not automatically bad — plenty of everyday ingredients are made by converting one molecule into another. The problem is what's left over. The reaction produces byproducts and can leave residual acids and solvents behind, and because the category grew faster than the testing standards did, a lot of products never got checked for any of it. The FDA has specifically flagged that delta-8 products may not be systematically tested for heavy metals, solvents, or contaminants.

Delta-8 will fail a drug test

This is the single most common thing people get wrong. Workplace drug tests are immunoassays that look for THC metabolites — they were never built to tell delta-8 apart from delta-9. To the test, it's THC.

Full-spectrum CBD carries a small, cumulative drug-test risk from its trace THC. Delta-8 isn't a small risk. If you're drug-tested and you want hemp, broad spectrum is the answer — it's THC-free by design, and every batch has a COA showing it.

What changes for delta-8 in late 2026

Delta-8 exists because the 2018 Farm Bill defined hemp by its delta-9 THC content only. Section 781 of the appropriations act signed on November 12, 2025 closes that gap: it redefines hemp using a total-THC standard that counts delta-8 and THCA, and caps finished hemp products at 0.4 mg of total THC per container. Congress wrote in a one-year runway, putting the effective date at November 12, 2026.

As of late August 2026, that date is in play. On August 8, the Senate passed a stopgap funding bill 90-6 that would push most of the new restrictions to December 11, 2026, and rejected an amendment to keep the original date on schedule. The House hasn't acted. Until it does and the bill is signed, November 12 stands.

Here's the part most CBD brands aren't saying out loud: the 0.4 mg per container cap, as written, doesn't only hit delta-8. It would also sweep in ordinary full-spectrum CBD oil, including ours — a full-spectrum bottle contains trace THC well above 0.4 mg per container. Broad-spectrum THC-free products are unaffected either way. We're tracking the bills closely and we'll tell you plainly if anything changes for what we sell.

Why we don't sell it

We're a family business in Cincinnati, and delta-8 was never a fit. The category is built on an intoxicant sold beside the register with no age gate in much of the country, in a market where the FDA logged 2,362 poison-control exposure cases in fourteen months — 41% of them involving someone under 18.

That's not a judgment about anyone who uses it. It's a judgment about what we're willing to put our name on. We sell four products, they're all tested every batch, and none of them will get you high.
