Two compounds, one plant
Hemp makes many cannabinoids. CBD is the one most hemp extract is built around. Delta-9 THC is the one most people mean by "THC", the main compound behind the high from marijuana. ACS Laboratory, a hemp testing lab, puts it this way in its explainer (checked October 2026): delta-9 is the same molecule whether it comes from hemp or from marijuana, and the legal difference is about the plant, not the chemistry.
So when a gummy is called "hemp-derived delta-9", it is not a milder or different THC. It is delta-9 THC, usually made by converting hemp CBD in a lab or by extracting small amounts from the plant. What changes with the label is the legal argument, not the molecule.
How a gummy with THC can still be "legal"
The 2018 Farm Bill defines hemp as cannabis with no more than 0.3% delta-9 THC on a dry weight basis. The legal-THC gummy trend rests on that percentage. Gummies are heavy, mostly sugar and pectin, so a 5 gram gummy is 5,000 mg and 0.3% of that is 15 mg of delta-9 THC. A gummy that size can carry a dose that intoxicates and still stay under the percentage.
That reading is not settled. A legal writer at On Drugs (checked October 2026) argues the 0.3% test applies to the cannabis-derived material, not to the sugar and flavoring added around it, and that a THC extract stirred into a non-hemp gummy may not qualify as hemp at all. We are not lawyers and we do not know how a court would rule. We do know the rule has a gap that products are built to fit through.
Drug tests and what the lab says
ACS Laboratory is blunt about it: hemp-derived delta-9 can show on a drug test, because a test cannot tell hemp-derived delta-9 from the other kind. It cites a study that found delta-9 detectable from about three days after a single dose to about 30 days with regular use. We did not read that study ourselves, so take the range as a pointer, not a promise.
CBD alone is not what standard workplace tests screen for. The risk with hemp products is trace THC. What the states say
Because the federal rule leaves room, states fill it in. Many cap THC per serving or per package, some limit sales to licensed stores, and some ban intoxicating hemp products outright. In Alabama, House Bill 445 caps an edible at 10 mg of total THC per serving and 40 mg per carton, sold by licensed retailers to adults 21 and over, in person only.
