Hemp-Derived CBD vs Marijuana-Derived CBD: What Actually Differs

One plant, one molecule, two legal categories

Hemp and marijuana are not two species. They are both Cannabis sativa. 'Hemp' is a legal category the 2018 Farm Bill drew at 0.3% delta-9 THC by dry weight — at or under that line the plant is an agricultural commodity, above it the plant is marijuana and stays on Schedule I.

The CBD extracted from either side of that line is the same compound with the same structure. A COA cannot tell you which plant a CBD molecule came from, and neither can your endocannabinoid system. Everything that actually differs downstream — price, legality, who can sell it to you, whether you can put it in a suitcase — follows from that one number.

What the difference costs you in practice

Hemp-derived CBD travels. You can order it in Ohio, take it to Idaho, and mail it to your mother in Texas, because the Farm Bill explicitly protects interstate hemp commerce. Marijuana-derived CBD does not travel: it is licensed, taxed, and tracked by a single state, and carrying it out is a federal problem and usually a state one too.

Dispensary CBD also costs more per milligram, because cannabis excise taxes are layered on top of retail price in most legal markets. If what you want is CBD, the hemp side of the line is cheaper and more available. If what you want is THC alongside your CBD, the dispensary is the honest answer and we will tell you that — we don't sell it and can't.

State law still overrides the federal line

Federally legal does not mean legal everywhere. Idaho requires 0.0% THC under Idaho Code §37-2701, which rules out full-spectrum products even though they are Farm Bill compliant. Several other states have tightened rules on trace-THC and hemp-derived intoxicants over the last two years.

We ship all four of our products to all 50 states and publish what each state's law actually says rather than deciding for you. If your state requires zero THC, broad spectrum is the product that fits it.

The federal definition is being rewritten right now

P.L. 119-37 §781, signed November 12, 2025, replaces the delta-9-only test with a total-THC standard and caps a finished consumer product at 0.4 mg of total THC per container. That is per bottle, not per serving, and it is far below what a typical full-spectrum 30 mL bottle contains.

Those provisions were set to take effect November 12, 2026. On September 2, 2026 the President signed H.R. 6500, whose Section 2019 pushed most of them to December 11, 2026 — the same day the current government funding runs out. Cannabinoids the plant cannot produce naturally, like the converted delta-8 and THC-O compounds, still lose federal hemp status on November 12, 2026.

None of this bans CBD. Pure CBD and THC-free broad-spectrum products are not what the law is aimed at. Full-spectrum oil is the product category with a real question mark over it, and the date has already moved once, so treat any deadline you read — including this one — as the current answer rather than the final one.
