What THCA actually is
The hemp plant does not make THC. It makes THCA, which has an extra carboxyl group attached. Heat removes that group in a step called decarboxylation, and what is left is delta-9 THC. Our THCA glossary entry walks through the chemistry.
CBD works the same way. The plant makes CBDA, and heat turns it into CBD. The difference is what you end up with. The heated version of CBDA is CBD, which does not intoxicate. The heated version of THCA is THC, which does.
Why THCA flower is sold as "legal hemp"
The 2018 Farm Bill defines hemp as cannabis with no more than 0.3% delta-9 THC. Flower that is rich in THCA but low in delta-9 THC can pass that test on paper. The GreenState explainer we read (checked October 2026) quotes one cannabis attorney saying that, under federal law, delta-9 level is the only measure and other cannabinoids do not matter to legal status.
The same article quotes another attorney who calls this false marketing, since all cannabis would be hemp if it were true. We are not lawyers and we will not settle that argument. What we can say is that the legal picture is disputed, and "it is sold online" is not the same as "it is allowed where you live."
Labs test total THC, and states differ
GreenState reports that federal compliance testing for licensed hemp growers is done after decarboxylation, using the formula Total THC = (0.877 x THCA) + THC. So THCA is counted when a grower's crop is tested, even though a retail product may be marketed on delta-9 THC alone.
States go their own way. Several have banned or restricted smokable hemp, and some write rules that name THCA directly. Check what your state allows before you buy any flower, and do not rely on a seller's website to tell you.
Drug tests and driving
OutSFL, a sponsored explainer we read (checked October 2026), says THCA flower will fail a drug test once smoked or vaped, because the heat creates THC. That matches the chemistry. Tests look for THC metabolites, and they cannot tell hemp-sourced THC from any other kind.
No one can guarantee a drug test result, including for CBD. Full-spectrum products carry trace THC by design. If you are tested, ask your employer or testing provider before using any hemp product, and do not drive after using anything with THC in it.
